Πριν λίγες εβδομάδες διάβασα όλες τις αναρτήσεις σε αυτό το φόρουμ και είμαστε στην ίδια κατάσταση.
Σήμερα μίλησα με έναν δικηγόρο του οποίου την επαφή είχα ήδη, το όνομά του είναι Max Rosa, αν δεν τον γνωρίζετε, είναι ένας από τους μεγαλύτερους ειδικούς του διαδικτυακού τζόγου στην Ιταλία, αν όχι ο καλύτερος (πολλοί παίκτες πόκερ βασίζονται σε αυτόν για περιπτώσεις όπου γίνεται λόγος για κέρδη για δεκάδες/εκατοντάδες Κ ευρώ).
Του εξήγησα την κατάσταση και μου είπε ότι είναι μάταιο να περιμένω από την ADM να επιβεβαιώσει όλα αυτά που ήδη ξέρουμε, ότι δηλαδή είναι μαφία και ίσως να μην μας απαντήσουν άλλο ή σε καμία περίπτωση εμείς δεν θα πάρει τίποτα από αυτό, προσθέτοντας ότι μπορούμε επίσης να αγνοήσουμε τις επικοινωνίες τους, όπως ακριβώς κάνουν πάντα το δικό τους. Έτσι, είναι απολύτως χάσιμο χρόνου να παραπονιέστε, να τηλεφωνήσετε / να γράψετε κ.λπ.
Μικρή σημασία έχει επίσης αν αυτοί οι ηλίθιοι του Genius χρεοκόπησαν ή όχι. Μπορεί επίσης ο ιστότοπος να έχει εξαφανιστεί επειδή έχει ανασταλεί η άδειά του. σε περίπτωση χρεοκοπίας μπαίνει στο παιχνίδι η περίφημη εγγύηση. Δηλαδή: εκεί που ο παραχωρησιούχος (Genius) αποδείξει ότι έχει χρέη στο δημόσιο ταμείο και δεν είναι σε θέση να μας πληρώσει, θα πρέπει να το κάνει το Δημόσιο (μέσω Monopolies και άρα ADM).
Τον ρώτησα: υπάρχει περίπτωση να μην ξαναδούμε τα χρήματά μας;
Μου είπε ότι είναι μια πολύ ακραία υπόθεση, σε περίπτωση που η ADM αποδειχθεί ότι είναι χρέη εκατομμυρίων και δεν μπορεί να μας εγγυηθεί το ποσό μας, που ακόμα και αν προσθέσουμε πολλούς λογαριασμούς είναι μικρό (πολλές χιλιάδες ευρώ). Αλλά σε ακραίες περιπτώσεις, θα ήταν αυτός που θα μας έλεγε να σταματήσουμε γιατί δεν θα ήταν πλέον βολικό, καθιστώντας ένα θέμα πολύ μεγάλο για τις τσέπες μας και επίσης ριψοκίνδυνο.
Επομένως, πρέπει να εκδώσουμε αυτήν την προειδοποίηση, και το άλλο σημαντικό πράγμα που μου είπε είναι ότι θα ήταν καλύτερα να το κάναμε ως ομάδα (ένα είδος "ταξικής δράσης"), όλα με τον ίδιο δικηγόρο και θα ήταν πολύ βολικό να μοιράσει το κόστος, μειώνοντας το ποσό σε μερικές δεκάδες ευρώ ανά άτομο (ή μάλλον ανά λογαριασμό/ταυτότητα).
Σε ό,τι με αφορά, είχα ένα συνολικό ποσό μεταξύ 3,5 και 4,5 χιλιάδων ευρώ στους τρεις λογαριασμούς μου και θα ήθελα να κάνω ό,τι μπορώ για να προσπαθήσω να ανακτήσω τα γαμημένα μου χρήματα. Έχω επίσης έναν φίλο που βρίσκεται στην ίδια κατάσταση, οπότε είμαστε στα δύο. Και προσπαθώ να πιάνω τη διαφορά με άλλους ανθρώπους που και που με το ίδιο πρόβλημα.
Σας παρακαλώ λοιπόν να με ενημερώσετε εάν ενδιαφέρεστε να ανακτήσετε αυτά τα χρήματα. Καθώς διάβασα, είδα ότι είμαστε αρκετοί και όλοι έχουμε όχι ακριβώς μικρά ποσά. Γνωρίζετε (ή έχετε μιλήσει με) κάποιον άλλο σε αυτό το φόρουμ; Δεν ξέρω αν μπορώ να τους επισημάνω όλους σε αυτήν την ανάρτηση, τουλάχιστον αύριο θα προσπαθήσω να απαντήσω στα σχόλιά τους (ελπίζοντας να δουν την ειδοποίηση).
Εν τω μεταξύ, παρέμεινα με τον δικηγόρο και θα τα ξαναπούσαμε μέσα σε μια εβδομάδα περίπου. Ενημερώστε με, αντίο!

A few weeks ago I read all the posts on this forum and we are in the same situation.
Today I spoke with a lawyer whose contact I already had, his name is Max Rosa, if you don't know him, he is one of the greatest online gambling experts in Italy, if not the best (many poker players rely on him for cases where talks about winnings for tens/hundreds of K euros).
I explained the situation to him and he told me that it is useless to wait for ADM to confirm all the things we already know, that is, that they are a mafia and maybe they won't even answer us anymore or in any case we won't get anything out of it, adding that we can also ignore their communications just like that they always do their own thing. So, it is absolutely a waste of time to complain, call/write etc.
It also matters little whether these idiots from Genius went bankrupt or not. It may also be that the site has disappeared because its license has been suspended; in the event of bankruptcy the famous surety bond comes into play. That is: where the concessionaire (Genius) demonstrates that it has debts with the treasury and is not able to pay us, the State will have to do so (through Monopolies and therefore ADM).
I asked him: is there any chance we won't see our money again?
He told me that it is a very extreme hypothesis, in the event that ADM proves to be millions in debt and cannot guarantee us our sum, which even if we add together several accounts is still small (several thousand euros). But in extreme cases, he would be the one to tell us to stop because it would no longer be convenient, becoming an issue too big for our pockets and also risky.
We therefore need to issue this warning, and the other important thing he told me is that it would be better if we did it as a group (a sort of "class action"), all with the same lawyer and it would be very convenient to divide the costs, lowering the amount to a few tens of euros per person (or rather per account/ID).
As far as I'm concerned, I had a total sum of between 3.5K and 4.5K euros in my three accounts, and I would like to do everything I can to try to recover my fucking money. I also have a friend who is in the same situation, so we're at two. And I'm trying to catch up with other people here and there with the same problem.
So I kindly ask you to let me know if you are interested in recovering this money. As I read, I saw that there are quite a few of us and all of us have not exactly small sums. Do you know (or have talked to) anyone else on this forum? I don't know if I can tag them all in this post, at least tomorrow I'll try to respond to their comments (hoping they'll see the notification).

Alcune settimane fa ho letto tutti i post di questo forum e siamo nella stessa situazione.
Oggi ho parlato con un avvocato di cui già avevo il contatto, si chiama Max Rosa, se non lo conosci comunque è uno dei maggiori esperti d'Italia di gambling online, se non il migliore (molti pokeristi si affidano a lui per cause dove si parla di vincite per decine/centinaia di K di euro).
Gli ho spiegato la situazione e mi ha detto che è inutile aspettare ADM confermandomi tutte le cose che già conosciamo, cioè che sono una mafia e magari neanche ci risponderanno più o comunque non ne caveremo nulla, aggiungendo che possiamo anche ignorare le loro comunicazioni tanto alla fine fanno sempre di testa loro. Quindi, è assolutamente una perdita di tempo fare reclamo, telefonare/scrivere ecc.
Inoltre ha poca importanza se questi idioti di Genius siano falliti o meno. Può anche darsi che il sito sia sparito perchè gli è stata sospesa la licenza, in caso di fallimento entra in gioco la famosa garanzia fideiussoria. Cioè: laddove il concessionario (Genius) dimostrerà di avere debiti con l'erario e di non essere in grado di pagarci, dovrà farlo lo Stato (tramite Monopoli quindi ADM).
Gli ho chiesto: c'è qualche possibilità che non rivedremo i nostri soldi?
Mi diceva che è una ipotesi molto estrema, nel caso che ADM dimostri di essere indebitata per milioni e non può garantirci la nostra somma, che anche sommando più conti è comunque esigua (diverse migliaia di euro). Ma in casi estremi, sarebbe lui a dirci di fermarci perchè non sarebbe più conveniente, diventando una questione troppo grossa per le nostre tasche ed anche rischiosa.
Bisogna quindi fare questa diffida, e l'altra cosa importante che mi diceva è che sarebbe meglio se la facessimo in gruppo (una specie di "class action"), tutti con lo stesso legale e risulterebbe molto conveniente per dividerci le spese, abbassando la somma a poche decine di euro a persona (o meglio a conto/ID).
Per quanto mi riguarda, io avevo sui miei tre conti una somma totale che oscilla tra i 3,5K e 4,5K euro, e vorrei fare il possibile per provare a recuperare i miei cazzo di soldi. Ho anche un amico che è nella stessa situazione, quindi siamo a quota due. E sto cercando di recuperare qua e là altre persone con lo stesso problema.
Quindi ti chiedo cortesemente di farmi sapere se sei interessato a voler recuperare questi soldi, leggendo ho visto che siamo non pochi e tutti con somme non proprio piccole. Conosci (o hai parlato) qualcun altro in questo forum? Non so se riesco a taggarli tutti in questo post, al limite domani provo a rispondere ai loro commenti (sperando che vedranno la notifica).
