Madonna, ακόμα και να διαβάζεις τις φιγούρες σου σε κάνει να τρέμεις. Θα σου πω ότι εδώ και μήνες το θεωρώ χαμένο, αλλά πρέπει να γίνει προσπάθεια. Αν ήταν μερικές εκατοντάδες ευρώ δεν θα με ένοιαζε, αλλά είναι σημαντικά νούμερα και από ότι βλέπω τα δικά σου είναι ακόμα μεγαλύτερα!
Έκανα και την καταγγελία στην ADM και όπως εσείς (και όλοι οι υπόλοιποι που έχουν παραπονεθεί) έλαβα το περίφημο email από την ADM με θέμα "οι αναλήψεις δεν επεξεργάζονται".
Λοιπόν ενήργησα όπως εσείς: την 1η Φεβρουαρίου έστειλα ένα PEC στο Genius και για πληροφορίες στον ADM, προφανώς ο Genius δεν απάντησε (αυτό δεν είναι νέο, είχα ήδη διαβάσει ότι δεν απάντησαν ποτέ σε PEC και αυτό τα λέει όλα) , ενώ περίπου είκοσι μέρες αργότερα η ADM απάντησε με το συνηθισμένο email που λάβαμε όλοι.
Το γεγονός είναι ότι δεν μπορούμε να το αποδείξουμε αυτή τη στιγμή! Δεν μπορείτε πλέον να έχετε πρόσβαση στον ιστότοπο, στην πραγματικότητα έχει εξαφανιστεί εντελώς. Στην περίπτωσή μου είχα κλείσει απευθείας τους λογαριασμούς περιμένοντας να εκκαθαριστεί το υπόλοιπο, οπότε δεν μπορούσα να παράσχω αυτήν την απόδειξη ούτως ή άλλως. Όλα αυτά όμως τα είχα ήδη εξηγήσει στον δικηγόρο, δηλαδή ότι ο ιστότοπος δεν είναι πλέον ορατός και ότι δεν είχα αποδείξεις για το υπόλοιπο, στην πραγματικότητα για να είμαι ειλικρινής δεν θυμάμαι καν τα ακριβή ποσά γιατί δεν τα έγραψα κάτω, αλλά απάντησε αμέσως σε αυτό, που είναι δεδομένα που μπορούν να βρεθούν αργότερα επειδή είναι όλα καταγεγραμμένα, οπότε θεωρητικά δεν πρέπει να το φοβόμαστε αυτό.
Σχετικά με την εγγύηση της εγγύησης σκέφτομαι κι εγώ όπως εσύ, αλλά αν μου έλεγαν ότι είναι διατεθειμένοι να μου δώσουν τα μισά (γιατί δεν έχουν αρκετή κάλυψη κλπ) θα δεχόμουν. Ο θείος σου έκανε ό,τι μπορούσε στο πλαίσιο των αρμοδιοτήτων του, ο δικηγόρος με τον οποίο μίλησα (μπορείς να κάνεις έρευνα στο διαδίκτυο) είναι ειδικός στον τομέα, οπότε το μόνο που έχεις να κάνεις είναι να βασιστείς σε αυτόν και να ελπίζεις για το καλύτερο. Σίγουρα με τις φιγούρες σου δεν μπορείς να μείνεις άπραγος, πάμε βήμα βήμα να δούμε πως θα εξελιχθεί.
ΥΣΤΕΡΟΓΡΑΦΟ. Έχετε εκδώσει προειδοποίηση και για τους τρεις λογαριασμούς;

Regarding the surety guarantee, I also think like you, but if they told me that they were willing to give me half (because they don't have enough coverage, etc.) I would accept. Your uncle did what he could within his powers, the lawyer I spoke to (you can do research online) is an expert in the field so all you have to do is rely on him and hope for the best. Surely with your figures you can't sit idle, let's go step by step and see how it evolves.
PS. Have you issued a warning for all three accounts?
Madonna a leggere anche le tue cifre c'è da tremare. Ti dirò che io li considero già da mesi come soldi persi, ma un tentativo va fatto. Fossero alcune centinaia di euro me ne sbatterei, ma sono cifre consistenti e da come vedo le vostre sono ancora più alte!
Il reclamo ad ADM lo feci anche io e come te (e tutti gli altri che hanno fatto reclamo) ho ricevuto la famosa mail di ADM con oggetto "prelievi non evasi".
Quindi ho agito come te: in data 01 Febbraio ho inviato PEC a Genius e per conoscenza ad ADM, ovviamente Genius non ha risposto (non è cosa nuova, avevo già letto che non hanno mai risposto alle PEC e già questo è tutto dire), mentre una ventina di giorni dopo ADM ha risposto con la solita mail che abbiamo ricevuto tutti.
Il fatto è che non possiamo averne la prova in questo momento! Non si può più fare accesso al sito anzi è totalmente sparito. Nel mio caso avevo chiuso direttamente i conti aspettando la liquidazione del saldo, quindi non potrei comunque fornire quella prova. Ma avevo già spiegato tutto questo all'avvocato, e cioè che il sito non è più visibile e che io non avevo prove del saldo, anzi a dirla tutta non ricordo neanche gli importi esatti perchè non me li segnai, ma a questo mi rispose subito che è un dato che si può reperire successivamente perchè è tutto registrato, quindi in teoria non dovremmo temere questo.
Riguardo la garanzia fideiussoria la penso anche io come te, ma se mi dicessero che sono disposti a darmi la metà (perchè non hanno abbastanza copertura ecc.) accetterei. Tuo zio ha fatto quanto poteva nelle sue facoltà, l'avvocato con cui ho parlato (puoi fare ricerche online) è esperto nel settore quindi non resta che affidarsi a lui e sperare bene. Sicuramente con le vostre cifre non si può restare con le mani in mano, andiamo step by step e vediamo come si evolve.
PS. La diffida l'hai fatta per tutti e tre i conti?
