I have had a legally binding German court judgment against Mr Gr for about a year now, and they still haven't paid. They even got a default judgment first and only then filed a defense.

Habe seit ca 1 Jahr ein rechtskräftiges deutsches Gerichtsurteil gegen Mr Gr. Und die haben bis heute nicht gezahlt. Haben sogar als erstes ein Versäumnisurteil kassiert und erst danach eine Verteidigung angezeigt.

It is clear that the advertising slogan and everything that could be read on the well-known law firm websites was written in such a way that everyone could assume that the whole thing was a clearly victorious matter that would be implemented quite quickly (in my case a period of between 6 and 10 months was mentioned!

Normalerweise müsste man die eigenen Anwälte auch in Verantwortung ziehen können ! Denn diese haben ganz klar mit völlig falschen Versprechen geworben und falsche Hoffnung verteilt !

Ganz klar waren die werbeslogan und alles was man so auf den bekannten anwaltskanzlei Seiten lesen konnte so geschrieben, dass ein jeder davon ausgehen konnte,dass das ganze thema eine eindeutig siegreiche Sache ist die recht schnell umgesetzt ist ( bei mir wurde ein Zeitraum zwischen 6 und 10 Monaten erwähnt!

Bei mir wurde auch so um die 18 Monate maximal genannt und dann eben hat man einfach mal 3 Jahre nicht geantwortet.

ja nur wie will man das machen ? Man hat ja den blöden Vertrag unterschrieben und da steht ja keine Frist am Vertrag ?

Selbst wenn es für uns gesprochen worden wäre, wären die OC in Berufung gegangen.

Und andersrum gehen wir in Berufung.

If the ECJ overturns the rulings, then our rulings will also be judged in the opposite way and the OCs will demand the return of all the legal fees and payments made. It would be a shame if the PKFs were insolvent then or already (to be on the safe side), because then we would have to bear the entire costs ourselves!

So be warned, there is no such thing as a risk-free lawsuit. The PKFs are not mentioned in the judgments because you are all plaintiffs yourselves!

Sollten der eugh die Urteile kippen, dann werden auch unsere Urteile gegensätzlich beurteilt und die OCs werden die gesamten prozessgebühren und getätigten Zahlungen zurückfordern. Dumm nur, wenn die PKFs dann oder jetzt schon (zur Sicherheit) insolvent sind, denn dann tragen wir selbst die gesamten Kosten!

also seid gewarnt, die riskikofreie Klage gibts dann wohl doch nicht. Die PKFs sind ja in den Urteilen nicht erwähnt, da ihr alle selbst Kläger seid!

Formal legal force means that a judgment (decision) can no longer be contested by ordinary legal remedies!!!!

Wird ein Urteil nicht mehr verändert (weil es von keiner Seite angefochten wird) bzw. kann es nicht mehr verändert werden (weil es nicht mehr angefochten werden kann), so ist das Urteil „rechtskräftig". Ein rechtskräftiges Urteil muss vollstreckt (umgesetzt) werden.

Formelle Rechtskraft bedeutet, dass ein Urteil (Beschluss) mit ordentlichen Rechtsbehelfen nicht mehr angefochten werden kann!!!!

Unless the ECJ overturns it and there are demands for repayment, which is to be expected. No one is likely to be insured and the PKF insolvencies are fine. That's what my lawyer told me 👍 so that could backfire massively...

Außer der EUGH kippt es und es gibt Rückforderungen, was zu erwarten ist. Versichert ist wahrscheinlich keiner und die Insolvenzen PKFs fein raus. So die Info meines Anwalts 👍 also das kann massiv nach hinten los gehen…..
